Right Of Widow To Inherit From Property Of Deceased Husband:
According to Quranic and law of the land, the widow is entitled to inherit her share in the property, whether moveable or immoveable, of her deceased husband. If the husband has died and the couple was childless then her share is 1/4th of the property and if there is child then her share would be 1/8th of the property.
As the widow becomes co-sharer, along with others, in the inherited property of the deceased immediately after the demise of her husband, therefore, no other co-sharer can evict her forcibly from her residence. In case she is forcibly evicted from the property then under section 9 of Specific Relief Act 1877 she can take possession of the property from where she was evicted. However, it is essential that suit for the same must be filed within six months of such eventuality
