Right of Maintenance Of Divorcee/Widowed During Iddat Period:
There are only two ways when a wife would endure the Iddat priod;
1. In case the wife is divorced or on dissolution of Nikkah
2. In case the husband is dead.
In both the above noted cases the period of Iddat is different. In the case of divorce or dissolution of marriage the period of Iddat is three menstrual cycles or three months (Al-Talaq, 4). This time period will be calculated after Talaq has become effective.
In the case where husband has died the Iddat period is four months and ten days (Al-Baqra-234). However, if the wife would be pregnant at the time of divorce, dissolution of marriage or the death of husband, the Iddat period is till the childbirth (Al-Talaq, 4).
The husband is bound to maintain divorced wife during the Iddat period and if he refuses to pay her this right then she can approach court for grant of the same. The husband is legally and religiously bound to maintain the divorced wife during iddat period.
In case where the husband has died, the widow has the right to live in his house for one year and she is also entitled to maintenance amount (Baqra-240). Such maintenance would be paid from the property of the deceased husband and it would not be considered as part of right of inheritance.
