POWERS OF PROVINCIAL GOVERNMENT

Under Section 527 Cr. P. C. the provincial government is authorized that it can transfer, through declaration in official gazette, that a particular case or appeal from one High Court is transferred in any other High Court or from subordinate court of one High Court to the subordinate court of another High Court having equal or higher powers. Wherein, the provincial government understands that such a transfer is necessary to meet the ends of justice or for general facilitation of parties or witnesses.
The condition for such transfer is that no case or appeal shall be transferred to other court or High Court without prior permission of provincial government of such. The court to which such case or appeal has been transferred shall hear it as if the same has been presented before such court from the beginning. |
