CRIMES OF USE OF CRIMINAL FORCE, ASSAULT AND PUNISHMENTS
CRIMINAL FORCE: Under section 350 of Pakistan Penal Code, Criminal Force is defined as any force with criminal intent which is to cause harm, injury, fear, strain and grief on a person and consent, will of such person is not involved in such criminal act. For example, a person, while walking in a street pushes another person with such a force and intent to cause him to fall down or cause hurt or any other harm or to cause fear or cause anger to the effect that such person would react in negative, then, the person who started the initial act of using criminal force would be guilty of this offence and would be punished accordingly. Following are the ingredients that complement an act of Criminal Force; 1) Intentional use of criminal force against a person 2) Use of criminal force without consent of a person 3) Use of criminal force with criminal intent 4) Use of criminal force with intent to cause hurt, damage, fear or anger in a person. ASSAULT: Under section 351 Pakistan Penal Code when a person adopts such a manner or indicates such an intent or makes such preparation with the intention and knowledge that other person present there understands person so adopting such manners and indication is going to attack then such an act would be called crime of criminal assault which would be punishable. It is pertinent to mention that mere usage of oral words does not come in to the domain of definition of criminal assault unless such oral words are accompanied by adoption of such manner or indication which would culminate in physical assault. For example, a person waves his fist in front of another person with the intention that the other person would understand that the person is going to attack, then, the person so waving his fist has done the act of criminal assault.
