CRIMES OF ABORTION AND FETUS ABORTION:
According to Pakistan Penal Code the crimes of abortion and fetal killing are defined and punished as; ABORTION: According to Sec. 338 of P.P.C. abortion is defined as that act in which a woman wastes away such a child in her womb whose limbs have not formed yet, thus, causing its death before its birth. If abortion is meant to save the life of the woman and it becomes necessary to do such an act during her medical treatment, then, such act does not become illegal. On the other hand, if this act is performed by the pregnant woman without any reasonable cause then the same act would become a crime. If the woman does abortion on her own accord the same would also be considered as crime of abortion. ABORTION OF FETUS: Under Sec. 338-B abortion of fetus is defined as that act of wasting away of an unborn child where the child in the womb of the pregnant woman has developed some limbs and it is in the growing stage. If such an act is performed to save the life of pregnant woman and it is done in good faith during medical treatment then it does not become illegal. On the other hand, if this act is performed without any reasonable medical cause then the same act becomes a crime, whether the performer of the act is a medical doctor or the pregnant woman herself does the same. |
