Court Decree/Order Obtained By Fraud, Misrepresentation Or Lack Of Jurisdiction: The intent of law in civil disputes is that the entire disputed matters between the litigating parties should be resolved once and for all. Before the incorporation of Sec. 12 (2) in Civil Procedure Code 1908 no court decree or order could be challenged through civil suit. However, after incorporation of the said section, any court decree, order or decision which is obtained by fraud, misrepresentation or which lack court jurisdiction can be challenged. Such challenging does not require institution of a separate civil suit, rather, an application can be place before the same court who passed any such decree or order. The reason for this simple procedure is to safeguard interests of the people from unlimited court litigations. |
